I don't know of patents covering AAC, but as I understand it, France does not have software patents. Maybe vlc-devel can tell you more about their approach. If you are worried by patents, I strongly suggest either seeking professional legal advice, or supporting the patent-free formats. Why would anyone want to support a format possibly patented anyway?
