I found the license grant in the README.torque file. torque packages (<=2.4) are using the original license. "It may be utilized, modified, and distributed subject to the constraints of the license located in the PBS_License.txt file." and torque packages (>=2.5) are using the new introduced license. "It may be utilized, modified, and distributed subject to the constraints of the license located in the PBS_License_2.5.txt file." Current upstream is not the copyright holder of the original code.
