I recently upgraded to Version: 0.0.23-2 and I am using xmlto all day

I have not seen this.
nadon@ubuntu:~/xorg/src$ aptitude show xmlto
Package: xmlto
State: installed
Automatically installed: no
Version: 0.0.23-2
On the other hand, I ran "xmlto --skip-validation txt conftest.xml"
with a zero byte conftest.xml file and I have the same bad results as
you do.
