Yes. You'll find a fair amount of legitimate E-mail (mostly sent from web
pages) that fails the SPAMHEADERS test. Typically this is because the
software sending out the mail was written by lazy programmers
(specifically, they did not take the time to add a Message-ID: header,
knowing that some servers would mark the E-mail as spam).
The BADHEADERS test is a different story. The *only* mail that will fail
the BADHEADERS test is mail that is spam, or sent from a broken mail
client. Mail failing the BADHEADERS test could be legitimate, but note
that even if you do not treat it as spam, it's very likely that another
mail server or client will either treat it as spam, delete it because it is
malformed, or another type of unpredictable response.
