As a veteran reader of IANAL discussions on slashdot about the GPL I think
that I can clear up this issue.
If Kylix depended on any GPLed code then it would be required to be GPLed as
well. But since Borland write all the code inside of Kylix, and thus hold
all the rights to said code, its can license the code in as many ways as it
likes. It already has the CLX available under two licenses (GPL and its
normal commercial license) and nothing prevents them from adding more.
So even if Kylix relies on the GPLed CLX, Borland is perfectly free to also
grant itself rights to use the CLX in its own closed products. And so you
can have a GPLed code base being used in closed source, but only by the
original author.
But if Kylix ever included code only available under the GPL and no other
license then Borland would before to either open the full source, or face
the wrath of Richard Stalman and other such persons.
The really huge question is what is the Project Jedi going to do about
licensing? Currently all the Jedi code is released under the MPL, which is
incompatible with the GPL, and so you can use any Jedi source with the open
versions of Kylix.
So either all the Jedi code needs to be dual licensed, or you don't use Jedi
code with open Kylix, or you break the licensing and get your self into hot
water.
