it is only solved by increase spacing to 68, see that blank space on the
right in omer's screenshot, however if I set unity launcher to
"neverhide", the spacing can be 0 they still won't overlap, now if the
launcher is suppose to be there anyway, shouldn't compiz acknowledge
that, don't put windows on 68px to the left. should I post this bug in
compiz?

The launcher is set to 'Dodge Window' (the default). Activating the
scale plugin with two open windows draws the one window under the
launcher. I.e. the launcher does not correctly dodge the scaled
windows (screenshot). This happens whether the launcher is visible
just before activating scale or not. This also occurs with a single
maximized window. The launcher is hidden (whether in dodge or autohide
mode), but reveals itself as soon as scale is activated, which also
covers the left edge of the scaled window below it.
