I figured this out.

My anchor was not being set correctly. Any non
character anchor makes this work.

Unless I am reading it incorrectly pg 529 of the
developers guide needs to be updated "Drawing objects
cannot be inserted into headers or footers.", I have
successfully put an image in a header.
