AFAIK, there is no such situation, where it is illegal to create an element.
But I think I do understand the original reasoning of why a modelelement's
owner is only set at mouse-release: E.g. in case of a class: You can drag it
on a package between mouse down and up. The owner depends on where you
release the mouse.
