There is at least one case where the shutdown listener would fail to start that 
is not a bug.  If the user specifies a port for the shutdown listener that is 
already in use (instead of the dynamic 0) or if the OS itself is completely out 
of available ports (EXTREMELY unlikely).  If that is the case, the server would 
have started up successfully, but the shutdown listener would fail leaving us 
no path to politely shut down the running server...  Not sure I really care 
that much just felt like the right thing to do.
