As a service have the data available for purchase as that will also give
you a legal edge 
In regard to a product that’s available for purchase

And that MAY actually keep them safe from some legal action...

Remember, that unless the copyright states that you can't use it on any
other website without prior written notice (or something) then people
can
use the data and say "it's from their site"... That's not illegal (so
long
as it's not a blatant copy of a significant portion of the data)...

I would suggest telling them to stop scraping the site, or charging them
for
content... (which may actually be a better way round for everyone!)
