We should commit this to trunk and 4.x so that we have repeatable builds (not failing for developers in country X but passing for developers in country Y). For 4.0: we have options available, we can commit it and respin, or we can simply mention in the errata that if you are going to generate javadocs, you should set some -D's as a workaround.
