This proposed legislation seems to mostly apply to state-level tax credits, abatements, loans and grants, but if it also applies to regular contracts, then OOo (and most non-MS applications and systems) have an advantage:

The proposal is to discriminate against companies which have been involved in illegal practices, offshoring, overseas tax shelters, poor performance in past contracts, etc.

The actual bill is expected to be introduced next week.
