Where are they located? Depending on the laws of that jurisdiction, it may be possible to get an injunction forbidding them from using the term "OpenOffice" in any communications related to products they are attempting to sell. The upside is that a violation of the injunction is contempt of court, which can mean jail time and hefty fines. If it's true malware, there may already been criminal violations happening and various justice ministries may need to be alerted.
