In theory, ui:include should isolate everything inside it, because the
intention of this tag is just insert everything, so I think in this case
myfaces behavior is correct.
Note this syntax is valid

<ui:define name="insertion">Inserted OK</ui:define>
</ui:composition>
[template.xhtml]
<h:body>
<ui:insert name="insertion"><ui:include src="insertion.xhtml"

If the previous example is not enough, you could use combinations of
ui:composition and ui:decorate
