Given this difference: Is this a corner case which may or may not be 
implemented in one or the other way (according to the spec) or is it a 
regression in either Jackrabbit or Oak ?

In the former case, I opt for removing the test (we cannot make sure the test 
ever passes on different implementations).

In the latter case, I opt for adapting the test to what is the intended 
behaviour and report an issue against the regression producing implementation.

Ok, there is a third option: The test is just buggy ;-)
