It probably won't matter, anyways. Contributory infringement is still
punishable.

The fact is that once a node operator is in the headlights of some
organization opposed to free data sharing -- private or public --
they're fuX0red regardless. The best-case scenario is that the
behemoth drops any charges or complaints if the node op kills their
node. The next best-case scenario is that they go to some kind of
heavy-duty civil rights trial ("BRANDON WILEY IN COURT FOR CHILD
PORNOGRAPHY TRIAL"), they get the EFF or some rights group behind
them, and they manage to convince a very friendly judge about the
intricacies of FNP and node behavior.

The best way to protect node operators from litigation and/or
prosecution is to make it tough to figure out who's operating a node.
That is, don't get caught in the first place. If it were the kind of
free, wonderful world where free speech gets the respect it deserved,
and everyone gets a fair cheap speedy trial, we wouldn't need Freenet
in the first place.
