I enabled IRQ in bios for VGA, and that error goes away. but when I do
that, it kills out my DVB card, with a " nobody cared" error "Disabling
IRQ 17", although the VIA VGA gets IRQ 11. so I try to play it back with
mplayer to see if it fixed my problem anways, and still no dice, 4-5
frames per second.

That's the likely cause of your problem. Without the IRQ handler, the
WAITVSYNC ioctl will not work (and will time out after 100ms). So
you'll only get 10 frames/second (or half that if you're using the
field parity option).
The IRQ number shouldn't be zero so you can start looking there.
