Legally, it's a very gray area itself. The FOIA has nothing to do 
with domain names.

What's at issue is whether YOU own the data about me (and hence can 
copyright it), or whether _I_ own the data about me.

If YOU own it, then you can put an NSI-like notice up, claim 
ownership and sue the pants off someone who abuses their license on 
the data. That ties up your lawyers and your energy. It also puts you 
at odds with people who will claim that their address and phone 
number and information about THEM belongs to THEM.

If I own it, then you might be able to put up a notice akin to "This 
data is copyrighted by the domain-holder, blah blah blah", but those 
blah's would have to (a) be CAREFULLY crafted, (b) agreed to by every 
domain-holder (not just resellers, for whom it is easy to change the 
rules on *G*), and (c) would probably VARY from domain-holder to 
domain-holder (depending on each company or person's personal 
requirements).

The first gets you into potential hassles, so does the second.

There are other points to this issue as well, I'm sure, but these are 
some highlights to think about.
