It's not my style to publically comment on the activities of our clientele,
so I'm not going to publically affirm that NSI is indeed a recipient of this
information. What I can say is that we have no reason to believe that they
have in any way received this information through anything but official
channels.
Tucows does have a program in place that allows any entity to sign a
contract, pay the annual subscription and receive a weekly dump of our
entire whois DB as a single file through a secure access mechanism. To date
I believe that there are four or five firms that subscribe to this service.
As you point out in a later message, it is an ICANN requirement to make this
data available to literally anyone that can meet the basic requirements. The
corollary to this is that other registrars data is available as well. It
immediately comes to mind that it might make some sense for a couple of
resellers to throw in together, lease NSI's data and do some direct mailing
of their own...
