And they don't.  ICANN and all accredited registrars do not authorize an
e-mail address to be used for marketing by third parties.  Read the
WHOIS license agreements, the ICANN registrar agreements, or individual
registrar's bulk access licenses for more information about this.

If a third party is using an e-mail address from WHOIS or bulk access,
then they are violating these agreements.
