Remember, though, with the US court system, he with the deepest pockets
sets the trial timelines.
If NSI has enough lawyers on this one, gets it heard right away and wins
the first round, forcing you to do the whole appeal process, etc. then you
win and countersue for legal fees, they may be able to stall the
countersuit long enough that their goal is accomplished anyways.
Just something to think about.
I'm told it took 25 years for the Poloroid v. Kodak suit to get to the
point which stopped Kodak from selling the unlicensed Poloroid patented
instant picture system. During those 25 years, Kodak made enough to cover
their legal fees and make some money on the side.
