If you challenge and win, you get the right to register under the sunrise rules, which means you either must have a qualifying trademark, or register fraudulently, just like the guy you challenged. Otherwise the registration is just cancelled. It is not clear to me if it would then become immediately available, or be placed in limbo, or who knows what else.
