That depends on how the gaining registrar authenticated it all.

Remember my previous rant on enom doing phone authentication?  It's very
possible that someone called them up masquerading as ST's customer and
they took that as authorization and authentication to do so.

It would be interesting to see what would have happened in the courts had
the transfer gone through...
