You'd have to talk to Network Solutions and/or ICANN about that.

If the losing registrar can't or won't provide a valid email address
for the owner of the domain, then the only way for OpenSRS to initiate
the transfer would be in violation of ICANN policies.

The only improvement I can think of would be an automated "retry queue"
for domains that had failed the first time.  (I'm under the impression
that this retry is done manually at the moment.)  It would probably
help for NSI's whois server, which tends to be up most of the time, but
it wouldn't help for cretins like 1dni.com and name7.com who often show
incorrect data, or naame.com and seoulregister.com who aren't even
running WHOIS servers at the moment.  In these cases, the only possible
response is a cocktail of "caveat emptor" and "I told you so".
