I would think that once the domain has expired, and your customer has long since left, that in the in 40 days after expirey, but before deletion, you could certainly lay claim to the domain if you wished. If there was interest in the domain, and the AWOL customer owed a past due balance, I would be especially inclined to do so. I have, in the past, sold a domain that had belonged to a prior customer. I did so only after getting a statement, in writing, that they did not wish to use or renew the domain any longer.
