It's got nothing to do with ICANN. You need a lawyer. The ICANN rule you refer to (The Uniform Dispute Resolution Policy -- should be linked from the user agreement anywhere you register domain names) allows the name to be taken away from you under certain conditions. But that doesn't mean you can keep the name if it doesn't meet those conditions. The only person who can answer your question is a lawyer who has had the opportunity to go over the details.
