And apart from in the case of big budget companies like NSI who can afford to spam via postal mail, most spam harvesters are only after email addresses. Other WHOIS data (name server info, dates, owner name) needn't be locked-off behind anti-spam measures. And registrars need to get at email addresses to confirm transfer requests.
