I think explicit opt-in is the only way to go, in my opinion. Even ICANN is hinting at that, via the advisories and latest consensus policy (i.e. the "which does not include failure of a registrant to respond" language). Otherwise, it has every appearance of a domain name theft/hijacking by the registrar. NSI's language of "You agree that we may, but are not obligated to, allow you to renew your domain name after its expiration date has passed." was particularly offensive.
