Because there was no legal entity - that is why a Foundation was needed from the outset. The only legal entity associated with OOo was Sun then Oracle (apart perhaps from some specific national organisations). It might be arguable in a court that what oracle has done is illegal but even if so who has the money to fight a lawsuit with Oracle? They will say that LibreO is a fork so anyone joining LO is effectively leaving the OOo community. There has already been discussion to that effect on the OOo marketing list. I think we need to move on. Put the energy into making LibreO strong.
