Are you sure?  This is only important issue that I see:

  "kernel/context switch support to save/restore the new registers"

Without this it seems that the program would be corrupted as soon as there is a context switch while AVX instructions are in use.

Otherwise, I agree that a program can just go ahead and use the instructions.
