I can't speak for Germany, but in the UK I think it's against the law (or at least very bad business practice) to take money before dispatching the goods. Also, if ordered by credit card, you can use the credit card company as leverage to reach a solution - either having the goods delivered or the order cancelled. I would suggest it's very much the fault of the merchant if they're taking money for goods they haven't dispatched, even if it was LT's fault for a lack of stock in Europe.
