You have to see what M&M is doing: It's a kind of file sharing service
between Apple and the users and AFAIK they do actually pay license fees
to the record labels to cover the cases where users might not actually
have owned that content.
Now, all of this assumes the record companies KNOW what's being mixed
and matched which is the iTunes catalog for which they do have
contracts. They will not add potentially unlicensed user content to
that library to distribute it to other users.

That's wrong. They place a limit of 1.000 songs in the cloud for stuff
that M&M doesn't find. The "unlimited" option only applies to their
catalog.
