Brilliant analogy! The problem is that certain legal issues are a bit more complicated than "if it looks like a duck, and quacks like a duck." Some people even go to school to learn about these issues and to be able to render informed judgements about particular cases. Do you also claim to have infallible intuitions about, say, the intricacies of tax law? This is a matter of interpreting U.S., Russian, and international copyright laws and U.S. import/export laws and applying them to an area that they were not designed to cover.
