Chris H is calling for a boycott of Apple:

It seems a little premature to me, since the iPhone is just vaporware
for now, but it would be nice if the FCC held Apple accountable.

The Telecommunications Act (ยง 255 1193.41) requires that all cell
phones be "Operable without Vision" but there has not been much
progress in market. Arguably, this is because only a "readily
achievable" level of effort is require. With the iPhone being more a
computer than PDA, and with OS X already incorporating a VoiceOver,
Apple would have a hard time claiming undue burden!
