I'd be willing to bet that even the new license excludes re-distribution
or has some other such clause to prohibit GPL implementations.
MS mouthpieces are emphasizing "Intellectual Property" [1], so control of
the format (and the related sw patents) is something MS is not likely to
relinquish. Rather MS seems to be lobbying to change definitions and
legislation to allow standards that are under control and owndership of a
single commercial entity. That's something that will take vigilance and
pro-active work on our part to prevent (again, and again, and again ... )
The possiblilty of later withdrawing the standard is another problem
with having a standard owned and under the control of a single commercial
entity. It is also possible, that MS is just stalling for time until the
lobbyists can finish their work.
