i regret any confusion caused by my mis-understanding of charles' post.
802.11y  opens up 3.65 - 3.7 ghz to wifi use, NOT just wimax,
except when it interferes with existing [grandfathered in] satellite
earth stations.
i believe there are 3 satellite earth stations in socal, but none in SD.

802.11 is a licensed band with the FCC license costing $200+.
This license is nationwide and non-exclusive.
i believe - but arent sure - this license will greatly increase - maybe up
to 50w - maximum power limits that 2.4 ghz wifi operates under.
