The benefit of doubt should be and is with them. It sounds like we have enough requests already, let's see what/if they reply. My outbox and personal memories are so full of pinging people and companies that have promised this or that source 'upon request', 'soon', 'next week' - to keep my mind free and happy I have long adopted a policy of "doesn't exist until it's released". Most likely they will tie any release to that specific requestor, including nda, patent licence/acknowledgment/waiver, etc. Andrey from Elphel had a fully functioning Ogg Theora RTL in the Elphel 323 camera, he never forward-ported it to 353, but the sources should still be out there... Now: spotlight on Google.
