Yes, it is intentional, because the section is descriptive, and not
prescriptive von TCP fallback behavior (which is documented elsewhere
iirc).

I would be good with making this <bcp14>MUST</bcp14>; However, I would
like to hear some more voices on the ML on this point.

I guess you mean the bottom of page 5; There it is lower-case for
similar reasons: it describes an error condition and not prescriptive
text. The corresponding prescriptive text is then in 4.1;

Again, I would have no issue with making this <bcp14>SHOULD</bcp14>;
However, again, more voices would be appreciated.
