I haven't read Tim's links, I just plumped straight for https://en.wikipedia.org/wiki/Cyber_Resilience_Act as an overview. That suggests the exception isn't for by licence, e.g. open source, but instead by how commercial it is. And that's a difficult, subjective line to draw.
