I tested it and it works great on new Linux releases.

I tracked the changed and backported them to my ethtool 6 and 2.6.18
kernel (yeah... I know I know).

Any reason why this doesn't the different behavior for
ixgbe_mac_82598EB type (as seen in ixgbe_setup_tc() ) ?
if (tc > adapter->dcb_cfg.num_tcs.pg_tcs ||
   (hw->mac.type == ixgbe_mac_82598EB &&
    tc < IXGBE_DCB_MAX_TRAFFIC_CLASS)) {
return -EINVAL;
}
