ok, then the problem is that the driver cannot properly shut down the PHY 
if a DA copper cable is used. WOL is not enabled on both boxes:
> ethtool eth0 | grep Wake
        Supports Wake-on: d
        Wake-on: d

Is this a bug in the driver or a hardware problem? Do you think this can
be fixed somehow? If so, can (or should) I file a bug report somewhere?

This effects the link selection process in Active-Backup bonds between
two boxes, for example.
