Having just listened to an interesting discussion of copyright and patent law on NPR the other day, I'm thinking the answer is legally, yes. Apparently copyright just happens when you create something, no filing or any other formal procedure is required. Morally, I'm on the "no" side, if you're not willing to sell/give/rent/tade/etc it to me and the CPSC hasn't recalled it, then I should be able to get it wherever I can and nuts to you, buddy.
