Really, neither is including phrases to the effect of "even though you own a
license and can use it to run stuff, you can't tell anyone how well it works
without our ok".

I'd be much happier if the phrase read something like "if you do publish
benchmarks or compatibility tests, you agree to furnish the vendor with a
copy of the tests so we can fix anything you found."
