On a more serious note, I think pure capitalism will render this problem
moot. We publish the results of all ejb containers. When the cease and
desist orders come in (from those with less than stellar scores), we change
the actual performance numbers to be something like "far worse than XXX", or
"bottom of the pile.".

I think those servers that score poorly will be the only ones complaining.
They can send us tips on how to improve performance, and we can readjust
their scores accordingly.
