To add to the chaos, disputes of infringement and the legitimacy of a
patent are in the Federal arena while the amount of damages, if any, are
decided by the state courts.

Not being a patent attorney myself (my field is regulatory compliance) I
have no first-hand experience with the USPTO, but abdication of
statutory responsibility seems to be this generation's hallmark of
Federal enforcement (including at my former Federal employer).
