Yep ... lots of jerks out there. Keep in mind, though, that while you might be able to hear all three hams (the guys already in QSO and the "jerk" that tunes up on top of them, the "jerk" might not be able to hear either of them. Depending upon the band, he might be too close to them geographically, or have a high local noise level, or have a directional antenna that favors you versus the other guys, or be using a much narrower filter than you are. It happens all the time.
