Makefile.PL takes the Apache paths from the mod_perl installation If your mod_perl was compiled with different Apache direcories, than on your current machine, Makefile.PL of Embperl don't find the files. By installing mod_perl, you have made sure that everything fits. I know that some tests fails with Perl 5.8.1, that are not problems of Embperl, but Problems of make test. These will be fix in the next release.
