I agree with my esteemed friend and colleague, Bob Martin, with one
exception.  The modulation techniques specified in EN 300 328 are spread
spectrum.  This being the case, the applicable FCC rule part would be
15.247, not 15.249.  We have tested a number of wireless LANs and all
have used spread spectrum technology.  Testing of the unintentional
portion is to 15.107 & 15.109.  The intentional portion would also
include 15.207 if powered by the AC Mains.  Per 47CFR Part 15.247, "In
addition, radiated emissions which fall in the restricted bands, as
defined in 15.205(a), must also comply with the radiated emission limits
specified in 15.209(a)..."
