Brian, and everyone

The EMC Directive itself has been under review by the SLIM (Simpler 
Legislation for the Internal Market) team of Government experts and 
industry.

They have recommended that a review of the EMC Directive be undertaken in 
a number of areas, one of which is differences between the Guidelines and 
the Directive, but the Guidelines have not been withdrawn.  SLIM has also 
recommended a review of CE + CE = CE.

The Guidelines are purely advisory.  In their introductory notes, they 
state that they are not binding - "the legally binding provisions are 
those transposing the EMC Directive" - these are the laws in each member 
state.

The fact that SLIM has recommended changes does not necessarily mean that 
they will happen.  The recommendations are being considered by the 
Commission, who should have produced a "Communication" to the Council of 
Ministers and the European Parliament by 9 November.  I understand that 
this has been delayed.  The Commission can reject some or all of the SLIM 
recommendations, but must give specific reasons if they so do.

This process is likely to result in proposals to amend the Directive (and 
as a consequence, the Guidelines) but this may take some time.
