I think you want to get into a legalistic argument, and I doubt that you are qualified to do so. I am not a lawyer either. But what I do know is that a defence is whatever you can get the court to accept. I did not say that a bald statement about a Directive would succeed; that's why one is 'represented' in court. The precise way of presenting the argument is all-important. As a fairly crude example, one might say that the words in the SI don't mean what the prosecution says that they mean. You refer to the words in the Directive from which the words in the SI were derived, and claim that they prove that the words in the SI mean what you say they mean. Now the prosecution has a problem.
